
Healthcare providers across the U.S. are encountering difficulties in ensuring that clinical decision support (CDS) tools do not unintentionally discriminate against patients, due to a lack of clear guidance from federal and regulatory agencies.
As artificial intelligence (AI) and machine learning technologies become more integrated into healthcare, these tools are increasingly used to assist with diagnoses, treatment recommendations, and patient monitoring. However, experts and institutions have raised concerns that these systems—often trained on historical patient data—can perpetuate or even amplify existing biases in medical practice.
Regulators have acknowledged the issue but have yet to issue comprehensive rules to guide healthcare organizations in identifying and mitigating algorithmic bias. Without concrete standards, hospitals and other providers are left to navigate a complex landscape on their own, with many unsure how to test their systems for fairness or adjust them appropriately when problems are found.
This regulatory gap has slowed efforts to develop CDS tools that are both effective and equitable. Stakeholders including clinicians, developers, and patient advocacy groups are calling for clearer direction from agencies like the Food and Drug Administration (FDA) and the Office of the National Coordinator for Health Information Technology (ONC).
Until such guidance is provided, providers risk deploying tools that may disadvantage certain populations—particularly communities of color, people with disabilities, and those from lower socioeconomic backgrounds—undermining the promise of AI to improve care outcomes for all patients.
