On July 2, the U.S. Department of Justice (DOJ) and the Department of Health and Human Services (HHS) announced the formation of the DOJ-HHS False Claims Act Working Group, a joint initiative focused on combating healthcare-related fraud under the False Claims Act (FCA). This new cross-agency collaboration underscores the federal government’s continued commitment to protecting public funds and enhancing accountability in the healthcare sector.
According to the joint statement, the DOJ-HHS False Claims Act Working Group will prioritize key areas where fraud has historically posed significant risks to federal healthcare programs. While the specific enforcement priorities were not fully detailed in the initial announcement, the group is expected to focus on areas such as fraudulent billing, kickbacks, and the submission of false data related to Medicare, Medicaid, and other federally funded health programs.
The initiative builds on recent enforcement trends where the DOJ has increasingly leveraged the FCA to pursue civil penalties, recover funds, and impose compliance requirements on healthcare providers and related entities found to be in violation of federal law. HHS, through its Office of Inspector General, will bring investigative expertise and oversight capabilities to the collaboration.
In a statement, DOJ officials emphasized the significance of the partnership as a force multiplier for fraud enforcement. “By combining DOJ’s litigation resources with HHS’s deep industry knowledge and programmatic oversight, we can more effectively detect, deter, and punish fraudulent conduct in federal healthcare programs,” said a department spokesperson.
The announcement also serves as a signal to stakeholders in the healthcare industry to maintain rigorous compliance programs and internal controls. With both agencies uniting their resources and strategies, enforcement actions under the ACA are likely to be more proactive and aggressive in the coming months.
This partnership reflects a broader trend within the federal government emphasizing inter-agency cooperation to safeguard public resources and combat waste, fraud, and abuse in critical sectors like healthcare.
